This is also known as a preliminary search report that uses the database (IPOPHL TMview) of pending and registered marks of the IPOPHL. The preliminary search report gives the applicant an indication of whether there are earlier filed trademarks already being examined or registered by the IPOPHL. The similarity report is more limited than the extensive trademark search conducted by the IPOPHL so it is possible that some earlier conflicting marks may not be included in the preliminary search report. The similarity report does not legally bind the IPOPHL—the examiner will issue the official search report as part of the office action or registrability report, if such action / report is issued by the Office.
